1. 著作権とライセンス1. Copyright & license
投稿したJAM（.arpjamファイル、およびそれをアプリで再生して生成される音楽。以下「本コンテンツ」）の著作権はあなたに帰属します。そのうえであなたは、YOKA／株式会社トゥエルブトーン（以下「当社」）に対し、本コンテンツを国内外で、無償・非独占・期間無制限・地域無制限に、複製・公開・配信・再生・展示・翻案・改変し、第三者へ再許諾（サブライセンス）する権利を許諾します（著作権法第27条・第28条に定める権利を含みます）。You retain the copyright in the JAM you submit (the .arpjam file and the music it generates in the app; the "Content"). You grant YOKA / twelvetone inc. ("we") a worldwide, royalty-free, non-exclusive, perpetual license to reproduce, publish, distribute, perform, display, adapt and modify the Content, and to sublicense these rights to third parties.
2. 配信される場所2. Where it appears
当社は本コンテンツを、JAM Libraryページに限らず、紹介ページ・試聴用プレイヤー・宣伝物・今後の製品やサービスなど、当社が適切と判断する範囲で利用・配信できます。投稿後は、あなたへの個別の連絡や許可なくこれらの利用が行われます。We may use and distribute the Content beyond the JAM Library page — e.g. landing pages, preview players, promotional materials, and future products or services — without contacting you each time.
3. 他のユーザーによる利用・改変3. Use & modification by other users
本コンテンツは、ARPJAMの利用者が取り込み・再生し、改変して新たな作品として公開・配布できます。あなたは、当社および当社がライセンスする第三者（他の利用者を含む）が本コンテンツをこの範囲で利用することに同意します。ARPJAM users may import, play, and modify the Content into new works and share them. You agree that we and the third parties we license (including other users) may use the Content in this way.
4. 著作者人格権4. Moral rights
あなたは、当社および当社が許諾した第三者による本コンテンツの利用に対して、著作者人格権（公表権・氏名表示権・同一性保持権）を行使しないものとします。ライブラリーでは登録したアーティスト名を表示しますが、二次利用の場面で常に表示される保証はありません。You agree not to assert your moral rights (rights of disclosure, attribution, and integrity) against use of the Content by us or those we authorize. We display your artist name on the library, but attribution is not guaranteed in downstream uses.
5. あなたの表明・保証5. Your warranties
あなたは、本コンテンツを自ら制作した、または投稿し本ライセンスを許諾する正当な権利を持つことを表明・保証します。また、本コンテンツおよびそれが生成する音楽が第三者の権利を侵害しないこと（既存楽曲の再現等でないこと）を保証します。万一紛争が生じた場合、あなたの責任と費用で対応するものとします。You represent that you created the Content or have the right to submit and license it, and that it (and the music it generates) does not infringe any third party's rights. You are responsible, at your own cost, for any dispute arising from your submission.
6. プリセットと著作権について6. About presets & copyright
.arpjam は音楽の録音ではなく、音を生成するための設定（プリセット）です。こうした設定（パラメータ）に著作権が及ぶかは、日本・米国・EU など主要国のいずれでも法律・判例上はっきり確立されておらず、一般に保護は限定的と考えられています（一方で、それを再生して得られる音や録音は別途の保護対象になり得ます）。本ライセンスは、仮に本コンテンツに何らかの権利が生じる場合に備え、その範囲で当社に利用を許諾するものです。An .arpjam is not a recording but a set of parameters that generate sound. Whether such presets attract copyright is not settled in law or case law in major jurisdictions (Japan, US, EU), and protection is generally considered limited — while the resulting sound or recording may be protected separately. This license applies to whatever rights, if any, exist in the Content.
7. 掲載の停止7. Removal
掲載の停止を希望される場合はご連絡ください。当社はライブラリーからの掲載を速やかに停止します。ただし、すでに配信・ダウンロード・取り込み・改変された分は回収できないことをご了承ください。Contact us to have your JAM removed and we will take it down from the library promptly. Note that copies already distributed, downloaded, imported, or modified cannot be recalled.
8. 準拠法8. Governing law
本条件は日本法に準拠します。These terms are governed by the laws of Japan.
